Terms of Service

Please read these Terms of Service ("Terms") carefully before using No Waffle Tutor (the "Service"), operated by Mohammad Ahmed Sheikh, trading as No Waffle Tutor ("we", "us", "our"), a sole trader based in the United Kingdom.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Who Can Use No Waffle Tutor

1.1 No Waffle Tutor is intended for students studying towards AQA A-Level Biology (or related qualifications), and for parents/guardians supporting them.

1.2 If you are under 18, you confirm that you have the permission of a parent or legal guardian to use this Service, including to make any payments. We recommend parents/guardians review these Terms and our Privacy Policy together with the student before signing up.

1.3 If you are 13 or under, a parent or guardian must create and manage the account on your behalf, and must provide consent for the processing of your personal data.

1.4 You must provide accurate information when creating an account and keep your login details secure. You are responsible for all activity under your account.

2. The Service

2.1 No Waffle Tutor provides revision content, flashcards, spaced-repetition review, practice questions, AI-marked assessments, an AI study assistant ("Ask the Tutor"), and related study tools for AQA A-Level Biology.

2.2 AI features. Some features use artificial intelligence (including third-party AI models) to generate explanations, mark answers, transcribe handwriting, and provide feedback. AI-generated content:

  • May occasionally be inaccurate, incomplete, or fail to reflect the most current AQA specification or mark scheme.
  • Should be used as a study aid, not as a substitute for your teacher, textbook, or official AQA materials.
  • Is not a guarantee of exam performance or grade outcomes.

2.3 We do our best to keep content accurate and up to date but do not guarantee that all material is error-free or fully comprehensive.

3. Subscriptions and Payments

3.1 No Waffle Tutor offers a free tier with limited access, and a paid "Premium" subscription (monthly or annual) offering expanded access, billed via Stripe.

3.2 Prices are shown at checkout in the applicable currency and may change from time to time; changes will not affect a billing period you have already paid for.

3.3 Subscriptions renew automatically unless cancelled before the renewal date. You can cancel at any time from your Settings page; your access continues until the end of the period you've already paid for.

3.4 Refunds. As this is a digital subscription service providing immediate access to content, we do not generally offer refunds for partial subscription periods, except where required by applicable consumer law (including your rights under UK consumer protection law if you are a UK resident).

3.5 If you are under 18, payments must be authorised by a parent or guardian, for example using their own payment card with their permission.

4. Acceptable Use

You agree not to:

  • Share your account or login details with others, or use another person's account.
  • Attempt to copy, scrape, resell, or redistribute our content or AI-generated outputs for commercial purposes.
  • Use the Service to upload or submit any content that is unlawful, abusive, or infringes someone else's rights.
  • Attempt to circumvent usage limits, paywalls, or security features of the Service.
  • Use the Service in a way that could damage, disable, or impair it, or interfere with other users' enjoyment of it.

5. Content and Intellectual Property

5.1 All lessons, flashcards, questions, branding, and platform design are owned by us or our licensors, except for official AQA specification extracts, which remain the property of AQA and are used for educational reference.

5.2 You may use our content for your own personal revision. You may not republish, resell, or share it outside your own study use.

5.3 If you submit content to the Service (e.g. written answers, uploaded photos of handwritten work), you retain ownership of it, but grant us a licence to process it (including via third-party AI providers) solely to provide the Service to you, such as marking or generating feedback.

6. Third-Party Services

To provide the Service, we rely on trusted third-party providers, including for authentication, payments, hosting, database storage, AI processing, and email delivery. Details of these providers and how they handle your data are set out in our Privacy Policy.

7. Disclaimers

7.1 The Service is provided "as is" without warranties of any kind, to the extent permitted by law.

7.2 We do not guarantee any particular exam grade, mark, or outcome from using the Service.

7.3 AI-generated marking and feedback are intended as a study aid and should not be relied upon as an official or definitive assessment of exam performance.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the Service, including loss of study time, data, or exam results. Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or fraud.

9. Suspension and Termination

9.1 We may suspend or terminate your account if you breach these Terms, misuse the Service, or where required by law.

9.2 You may close your account at any time via Settings or by contacting us. Subscription cancellation is separate from account deletion — cancelling your subscription stops future billing; closing your account removes your data as described in our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes (for example, via email or an in-app notice) before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere, mandatory consumer protection laws of your own country may also apply and are not affected by this clause.
